Terms and Conditions

1.       Promotion Period

The eBay UK eBay Trade-In December Deal (“Promotion”) will be open from 09:00 UK local time on 9 December 2024 until 23:55 UK local time on 3 January 2025 (“Promotion Period”).

 2.       Eligibility

This Promotion is open to users registered on ebay.co.uk (the “Site”) who are UK residents, and who must be 18 years of age or older.

3.       Procedure

This Promotion offers you an additional £50 (fifty pounds) on top of the assessed trade-in value under the Trade-In Programme (as defined below) (“Bonus Value”) where you meet all of the following conditions:

·    Trade-in an Eligible Device under eBay UK’s Trade-In Programme (available under https://trade-in.ebay.co.uk/) (“Trade-In Programme”) during the Promotion Period. Eligible Device means an Apple iPhone 11 or new models, or Samsung Galaxy S20 or newer models.

·    The Eligible Device is in working condition when assessed by the trade-in partner. Working condition means the device meets all of the following criteria:

a.  Powers on;

b.  Maintains all of the intended functionality of the device as set out by the manufacturer; and

c.  Free of significant damage with no cracks, chips, or severe/ deep scratches.

·    Select the bank transfer option under the Trade-In Programme.

 The Bonus Value will automatically be added to the trade-in value determined under the Trade-In Programme and not shown separately (“Total Amount”). The Total Amount will be transferred to the bank account specified under the Trade-In Programme within 5-7 days after the trade-in partner receives the Eligible Device at their warehouse for evaluation. Please note that the completion of the trade-in is subject to you sending your trade-in device to our trade-in partner, Fonehouse, and them confirming the accuracy of the information you provided in the trade-in questionnaire and that it is of working condition as set out above.

The Bonus Value cannot be transferred nor separately withdrawn as cash.

4.       Exclusions

Any attempt to manipulate the Promotion is prohibited and will result in exclusion from participation.

If eBay has suspicions or knowledge that any entrant has been involved in any fraudulent or illegal activity, eBay reserves the right to disqualify that users and any related entrants. eBay may also disqualify any user who does not act in accordance with these Terms and Conditions (or is acting in a way which contravenes the spirit and intention of these Terms and Conditions).

5.       Data Use and Data Privacy

Your personal data will be processed in accordance with the eBay User Privacy Notice.

Your personal data will be used by eBay in connection with the Promotion. eBay will do this on the basis of its legitimate interests in enabling eBay users to participate in the Promotion. You may contact eBay’s Data Protection Officer by post at 1 More London Place, London, SE1 2AF.

6.       Limitation of liability

eBay makes no representations or warranties of any kind regarding any product or service provided by any third party in connection with any promotion.

eBay shall not be liable, in contract or tort (including negligence) or the breach of statutory duty or in any other way, for the loss or damage howsoever arising suffered by the entrant resulting directly or indirectly from entry to this Promotion. Nothing in these terms shall limit eBay's liability for death, personal injury or fraud.

eBay will not be responsible for any third party's performance or failure to perform any services related to any promotion, or for any costs, damages, accident, delay, injury, loss, expense, or inconvenience that may arise in connection with the use of the Promotion, provided that nothing shall limit eBay's liability for death or personal injury caused by its negligence.

eBay does not accept, and is not responsible for, any lost or delayed entries. eBay reminds users of the nature and limitations of the Internet and is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software that may affect entry to the Promotion.

Although eBay will use reasonable efforts to ensure that all information relating to the Promotion is accurate, eBay is not responsible for any problems or technical malfunctions of any communications network, online system or computer hardware or software failure that may affect eBay's operation of the Promotion, including without limitation the accuracy of any Promotion Material.

7.       General

eBay reserves the right to suspend, change or cancel this Promotion at any time, in the event of circumstances arising which in eBay's opinion make it necessary for it to do so. eBay reserves the right to add additional terms and conditions for certain parts of this Promotion. 

 The decision of the adjudicator regarding any aspect of this Promotion is final and no correspondence will be entered into.

 eBay may use third parties to facilitate one or more elements of the Promotion. These third party service providers are subject to confidentiality agreements with us and other legal restrictions that prohibit the use of the information we provide them for any other purpose except to facilitate the specific outsourced eBay related operation.  These Terms and Conditions are governed by the laws of England and Wales. Each party irrevocably agrees to the exclusive jurisdiction of the English courts over any claim or matter arising under or in connection with these Terms and Conditions.
